DMCA Policy
Last Updated: July 4, 2025
Bralith Yonur respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") outlines the process by which copyright owners may notify us of alleged infringement and how we respond to such notices. This policy applies to all content hosted, transmitted, or made available through our services at ervelia.online.
1. Overview
We respond to notices of alleged copyright infringement that comply with applicable law and are properly submitted to our designated agent. We reserve the right to remove or disable access to content that is alleged to be infringing and to terminate the accounts of repeat infringers.
Nothing in this policy constitutes legal advice. If you are uncertain about whether specific content infringes your copyright or the copyright of another party, we recommend consulting a qualified legal professional before submitting a notice.
2. Reporting Copyright Infringement
If you believe that content available through our platform infringes upon a copyright that you own or control, you may submit a written notification to our designated copyright agent. To be effective under applicable law, your notification must include all of the following elements:
a) A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
b) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit us to locate the material. Providing URLs is the most effective way to help us locate the content quickly.
d) Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.
e) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
f) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Designated Copyright Agent
Please send all DMCA notices and related correspondence to our designated agent using the contact information below:
Bralith Yonur — Copyright Agent
10 King Street, Luton, Beds, LU1 2DP, United Kingdom
Email: info@ervelia.online
Phone: +44 7988 749175
We strongly recommend sending notices by email to ensure prompt processing. Notices sent by post will be processed but may take longer to receive a response.
4. Our Response to Valid Notices
Upon receipt of a valid DMCA notice that satisfies all of the requirements described above, we will take the following steps:
4.1 Content Removal
We will promptly remove or disable access to the allegedly infringing content and notify the user who posted or submitted the content that it has been removed or disabled.
4.2 User Notification
We will provide the affected user with a copy of the DMCA notice, where feasible, and inform them of their right to submit a counter-notification if they believe the content was removed in error.
4.3 Record Keeping
We maintain records of all DMCA notices received and actions taken in response. These records may be used to identify and address patterns of infringing behavior on our platform.
5. Counter-Notification Procedure
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. To be effective, your counter-notification must include all of the following:
a) Your physical or electronic signature.
b) Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
d) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the person who provided the original notification or an agent of such person.
Please send your counter-notification to the same designated agent address listed in Section 3 of this policy. Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party and inform them that the removed material may be restored or access re-enabled after a waiting period, unless we receive notice that the original complainant has filed a legal action seeking a court order restraining the user from the allegedly infringing activity.
6. Repeat Infringer Policy
In accordance with our commitment to respecting intellectual property rights, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. A user may be classified as a repeat infringer if they have been the subject of multiple valid DMCA takedown notices or if they engage in a pattern of infringing conduct on our platform.
We reserve the sole discretion to determine what constitutes repeat infringement and to decide when termination of access is warranted. Account termination for repeat infringement is in addition to, and not in lieu of, any other remedies available to us or to copyright owners.
7. False or Misleading Notices
Please be aware that under applicable law, any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to significant liability, including damages, court costs, and attorneys' fees incurred by the alleged infringer, the copyright owner, or any online service provider who relies on the misrepresentation. We encourage all parties to act in good faith and with care before submitting any DMCA notice or counter-notification.
8. Third-Party Content
Our platform may contain content uploaded, posted, or otherwise transmitted by third-party users. We do not pre-screen or actively monitor all user-generated content for potential copyright infringement. The presence of any content on our platform does not constitute an endorsement by us of that content, and we do not represent or warrant that such content does not infringe third-party intellectual property rights. We rely on rights holders and authorized representatives to notify us of any alleged infringement through the process described in this policy.
9. Licensed Content and Educational Materials
Certain content available on our platform may be provided under license from third-party rights holders for educational and training purposes. If you believe that any such licensed content has been used beyond the scope of the applicable license, please contact us using the information in Section 3 so that we may investigate the matter and take appropriate action.
10. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Any changes will be reflected by updating the "Last Updated" date at the top of this page. We encourage you to review this policy periodically to stay informed about how we handle copyright-related matters. Your continued use of our platform following any modification constitutes your acceptance of the updated policy.
